Legal notice

This Legal Notice applies to the Phantom Labs website (including phntmlabs3d.com), product listings, social accounts we operate, and related online materials (the “Site”). It should be read with our Terms of Service, Shipping Policy, and any Privacy Policy we publish. Using the Site means you have read this notice.

1. Operator
The Site is operated by Phantom Labs, a small custom fabrication studio based in the Tampa Bay area, Florida, United States. “Phantom Labs,” “we,” “us,” and “our” refer to that studio.
The Site is provided for information and for placing or inquiring about custom and catalog 3D-printed goods. Nothing on the Site is an offer that we must accept. An order is accepted only when payment clears and we confirm it.

Unless a page says otherwise, Phantom Labs owns or licenses the copyright in original Site content, including product photography we created, listing copy, original 3D designs, logos we designed for the studio, and page layout. Product photos of finished pieces we designed are also our copyright.
You may view and print pages for your personal, non-commercial use in connection with shopping or an existing order. You may not copy, scrape, republish, or sell our original designs, photos, or listing text without written permission.
Purchase of a physical item does not transfer copyright in the underlying model or artwork. You own the object you bought. You do not own the digital design unless we sell you that file in a separate written grant.

3. Trademarks
“Phantom Labs,” our logos, and any shop marks we display to identify the studio are trademarks or trade dress of Phantom Labs, whether or not a registration symbol appears. You may not use them to brand your own shop, listings, or products, or in a way that suggests we endorse you.
All other names, logos, team marks, character names, and brand identifiers that appear on the Site or on custom products belong to their respective owners. Their appearance does not mean those owners sponsor, approve, or are affiliated with Phantom Labs.

4. Third-Party Intellectual Property and Custom Work
We accept custom print requests, including customer-supplied files and designs that may depict third-party characters, teams, logos, or other protected material. When we do that work:
• The customer is responsible for having the right to have that content reproduced on a physical item;
• Printing an item is not a license from the rights holder and is not an endorsement by Phantom Labs that the design is cleared;
• We may refuse, cancel, or take down a listing if a platform or rights holder objects;
• We do not transfer any third-party IP to you by selling a print.
If you are a rights holder and believe material on the Site or a listing infringes your copyright or trademark, use the complaint process in Section 8.

5. Product Information and Photos
Listings, mockups, and photos are meant to describe the item we intend to make. 3D printing involves material batches, layer lines, color variation, and finishing marks. An item may differ slightly from the photo or from a previous order of the same design.

Dimensions, weights, and color names are approximate unless a listing states a measured tolerance. Props, stands, cards, or lifestyle items in a photo are not included unless the listing says they are.

We may correct errors in price, description, or availability. If the error is material and you have already paid, we will contact you before we ship or we will cancel and refund.

6. No Professional Advice
The Site does not provide legal, medical, engineering, or safety-certification advice. Printed parts are decorative or novelty items unless we expressly label a different use. Do not treat a blog post, listing, or message as a specification for a load-bearing, food-contact, child-safety, or regulated use.

7. External Links and Platforms
The Site may link to Etsy, social media, payment processors, or other third-party sites. Those sites have their own terms and privacy practices. We are not responsible for their content or for outages on those platforms. Marketplace purchases are also governed by that marketplace’s rules.

8. Intellectual Property Complaints
To report claimed copyright or trademark infringement involving Phantom Labs content or a listing, send a written notice that includes:
• Your name, organization, and contact email;
• The work you say is infringed and evidence you own or represent the rights;
• The exact URL or listing title and a description of the material;
• A statement that you have a good-faith belief the use is not authorized;
• A statement, under penalty of perjury, that the information in the notice is accurate;
• Your physical or electronic signature.
Send the notice through the contact method on phntmlabs3d.com or the marketplace listing. If the material is on Etsy or another platform, you may also use that platform’s official IP reporting tools. We may share your notice with the customer who submitted the design when the item was a custom request.
We will review complete notices and may remove or disable the material, cancel an unshipped order, or take other steps we consider appropriate. Submitting a false notice may have legal consequences.

9. Disclaimer
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOM LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful code, or that listing content will always be complete or current.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOM LABS AND ITS OWNER ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SITE OR FROM RELIANCE ON SITE CONTENT. LIABILITY RELATED TO A PURCHASE IS LIMITED AS STATED IN THE TERMS OF SERVICE AND WILL NOT EXCEED THE AMOUNT PAID FOR THAT ORDER.

11. Governing Law
This Legal Notice is governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Venue is as stated in the Terms of Service.

12. Changes
We may update this Legal Notice at any time. The Effective Date at the top will change. Continued use of the Site after an update is acceptance of the revised notice.

Legal and rights-holder correspondence: use the contact form or email published on phntmlabs3d.com, and put “Legal Notice” or “IP Complaint” in the subject line. Order questions should go through the shop or listing used for that purchase.
